Las servidumbres administrativas de gasoducto y el catastro 3D

Abstract

La evolución de la información geoespacial y la constante demanda de información de calidad y cantidad del territorio, hacen que los sistemas catastrales también se transformen. En este caso particular, se tratará el objeto territorial legal de Servidumbre Administrativa de Gasoducto como unidad de registración catastral. En primera instancia, se realizará una pequeña instrucción de la estructura catastral, sus aspectos fundamentales y ejemplificaciones. En segunda instancia, se desarrollará la concepción de los Catastros 3D, sus fundamentos jurídicos y aplicabilidad en el objeto territorial legal que nos incumbe. Finalmente, con el objetivo de generar la nueva concepción de un catastro en tres dimensiones, su importancia en sus aspectos económicos, jurídicos y geométricos, y haciendo una mención breve de la inserción de los aspectos ambientales para estas obras. Concluyendo, que para la registración catastral, debe estar presente el análisis integral de la parcela 3D que es afectada por la Servidumbre de Gasoducto 3D, con sus aspectos de posicionamientos y dimensiones tomados cuidadosamente y por sobre todo, definidas en la legislación catastral.

The evolution of geospatial information and the constant demand for information of quality and quantity of the territory, make the cadastral systems also transform. In this particular case, the legal territorial object of Gas Pipeline Administrative Easement will be treated as a cadastral registration unit. In the first instance, a short instruction of the cadastral structure, its fundamental aspects and exemplifications will be carried out. In the second instance, the conception of the 3D Cadastres, its legal foundations and applicability in the legal territorial object that concerns us will be developed. Finally, with the objective of generating the new conception of a cadastre in three dimensions, its importance in its economic, legal and geometric aspects, and making a brief mention of the insertion of environmental aspects for these works. Concluding, that for the cadastral registration, the integral analysis of the 3D plot that is affected by the 3D Gas Pipeline Easement must be present, with its aspects of positioning and dimensions taken carefully and above all, defined in the cadastral legislation.
