La participación ciudadana en la administración pública

Abstract

El tema de análisis es el relativo a la participación del ciudadano en la función administrativa, a través de los dos cauces generalmente postulados, a saber, la participación procedimental o tutelada (en el marco del procedimiento administrativo en forma previa al dictado del acto administrativo o reglamento) y la participación orgánica, merced a la incorporación del ciudadano individual o asociado, a través de sus representantes, en un órgano, generalmente colegiado, integrante de la estructura administrativa centralizada o descentralizada, tomando parte así de la expresión de la voluntad estatal. En tal sentido, advertiremos que algo que ya estaba planteado de manera aislada o en alguna regulación comparada, hoy tiende a ser una realidad con carácter general, en virtud de que a través de distintas normas – algunas constitucionales - se garantiza a la persona la participación como un derecho fundamental. Al respecto, veremos cuáles son los 4 distintos mecanismos participativos, y cuáles los más idóneos según el objetivo, marcando que no todos son intercambiables sino que unos son más eficientes que otros a la hora de garantizar una efectiva participación.The subject of analysis is on the involvement of citizens in the administrative function through two channels generally postulates, namely, procedural or supervised participation (under the administrative procedure to adjudication or rulemaking) and the organic participation, through the incorporation of the individual or associate citizen, through their representatives, in an organ, usually referee, member of the centralized or decentralized administrative structure, taking part and expression of the state will.
