Interpretación jurisprudencial de la Corte Suprema de Justicia de la Nación Argentina referente a los saqueos paraguayos en Bella Vista (1865)

Abstract

En el marco de la guerra de la Triple Alianza (1865-1870) y durante los meses de la ocupación y retirada paraguaya a la provincia de Corrientes, se produjeron importantes daños sobre la población civil. Si bien en todos los Departamentos correntinos ocupados se produjeron daños y perjuicios a la población civil, en algunos fue más intenso que en otros, el caso del poblado de Bella Vista adquirió dimensiones extremas. Al abandonar el ejército paraguayo el territorio correntino se iniciaron numerosos reclamos referentes a daños sufridos. La mayoría de ellos sólo tuvieron resonancia en la competencia administrativa, pero algunos pocos, llegaron a la esfera de la conflictividad judicial, y en ocasiones, los casos más relevantes, alcanzaron el tratamiento por la Corte Suprema de Justicia de la Nación. Las sentencias dictadas por este Alto Tribunal de Justicia argentino dan muestra de los criterios que tuvo este poder del estado respecto a casos directamente relacionados a las secuelas sufridas por la población civil.In the context of the War of the Triple Alliance (1865-1870) and during the months of Paraguayan occupation and retreat in the province of Corrientes there were significant damage on civilians, some stronger than others, as the case of the town of Bella Vista which acquired extreme dimensions. Once the Paraguayan army left the correntinian territory, numerous claims regardingsuffereddamages were made. Most of them had only resonance on the administrative competence, but few reached the area of judicial conflict, and sometimes, the most relevant cases were treated by the High Court of Justice of the Nation. The judgments of the argentinian High Court are an evidence of the criteria used by this power of the state regarding cases directly related to the consequences suffered by the civilian population.
