Estado, administración y realidad : la participación del ciudadano en la gestión pública

Abstract

En la presente Ponencia, intentaré mostrar de manera sucinta el basamento teórico de la creciente idea participativa de los ciudadanos en la función administrativa, sus causas, su vinculación con la idea democrática, y finalmente, la relación habida entre el ciudadano, la sociedad civil y el Estado, para arrojar luego unas conclusiones preliminares. La temática escogida constituye un nuevo modo de concebir al Derecho Administrativo, donde la otrora concepción de la potestado prerrogativa pública de que daban cuenta los clásicos maestros de la disciplina va dando lugar a una visión cooperativa entre el Estado y los ciudadanos en busca del consenso, al menos en aquellas decisiones relevantes que impactan en la vida de aquéllos y de la sociedad civil.In this paper, I try to show briefly the theoretical basis of the growing participatory idea of citizens in the administrative function, its causes, its links with the democratic idea, and finally, the relationship given between citizens, civil society and the state, then dumped some preliminary conclusions. The chosen theme is a new approach to the Administrative Law, where the former conception of public authority or prerogative that they realized the classical masters of thediscipline is giving rise to a cooperative vision of State and citizens in search of consensus at least in those important decisions that affect the lives of those and civil society.
