El concurso docente universitario. Análisis crítico y propuestas de mejora
The university teaching contest. Critical analysis and improvement proposals. Perception of the stakeholders involved
Resumen
El presente artículo tiene como objetivo analizar el Concurso Docente Universitario desde el paradigma del Estado Constitucional y Convencional de Derecho (ECCD) y del derecho fundamental a la Buena Administración, para el desarrollo de un procedimiento que respete el marco de juridicidad y de garantía en favor de quienes participan en él, satisfaga su cometido y contribuya a la mejora de la Educación Superior. Se reconoce al Concurso Docente Universitario como el procedimiento más adecuado para designar a los postulantes más idóneos y el marco normativo nacional y de cada universidad pública así lo reivindica. Sin embargo, en la práctica se evidencian desvíos en su implementación, lo que arroja un manto de dudas sobre su transparencia y credibilidad, empañando la institución universitaria en su conjunto. El abordaje teórico se realiza desde el ECCD, operativizando este gran marco de referencia, a través de las herramientas que brinda el derecho fundamental a la Buena Administración, de acuerdo a la Carta Iberoamericana de los Derechos y Deberes del Ciudadano en relación con la Administración Pública (CIDDCRAP, 2013). La metodología implementada ha sido la revisión bibliográfica y doctrinaria, la revisión del marco normativo nacional y la jurisprudencia y la realización de una encuesta de percepción a actores universitarios. Las conclusiones reivindican el instituto del Concurso Docente Universitario como mecanismo neurálgico de la Educación Superior Pública, que puede y debe ser mejorado para incrementar la transparencia y credibilidad de esta institución, considerada como una de las más prestigiosas para la sociedad. This article aims to analyze the University Teaching Competition from the paradigm of the Constitutional and Conventional State of Law (ECCD) and the fundamental right to Good Administration, for the development of a procedure that respects the framework of jurisdiction and guarantee for those who particípate in it, satisfies its role and contributes to the improvement of Higher Education. The University Teaching Competition is recognized as the most appropriate procedure for appointing the most suitable applicants and the national and public regulatory framework of each public university claims so. In practice, however, there are deviations in its implementation, which casts a cloak of doubts about its transparency and credibility, tarnishing the university institution as a whole. The theoretical approach is carried out from the ECCD, operativizing this great frame of reference, through the tools provided by the fundamental right to Good Administration, in accordance with the Ibero-American Charter of the Rights and Duties of the Citizen in relation to the Public Administration (CIDDCRAP, 2013). The methodology implemented has been the bibliographic and doctrinal review, the revision of the national regulatory framework and jurisprudence and the conduct of a perception survey of university actors. The conclusions claim the Institute of the University Teaching Competition as a nerve mechanism of Public Higher Education, which can and should be improved to increase the transparency and credibility of this institution, considered one of the most prestigious for society.
