Responsabilidad de las entidades financieras en la tutela de los intereses del deudor
Resumen
La simplicidad y facilidad con la que se otorgan los créditos en la actualidad, contribuye al sobreendeudamiento de los consumidores, generando una acuciante problemática económica y social, como así también de forma mediata, el congestionamiento de los tribunales judiciales. El deber de información juega un papel preponderante a fin de paliar esta situación, principalmente mediante su interpretación lata, entendiendo que no solamente exige la obligación de informar las condiciones de contratación, sino también la de recabar datos suficientes a fin de apreciar la capacidad real de pago del cliente. Asimismo, todas las entidades financieras se encuentran en el mismo deber de cumplir con esta obligación, aunque debe hacerse especial hincapié en aquellas que otorgan créditos a sola firma y tras la presentación del mero recibo de sueldo. El acatamiento de este particular deber de información contribuirá con la prevención del sobreendeudamiento de los consumidores y, si bien se entiende que la fuente de esta obligación es legal, debería surgir su respeto de la voluntad misma de las entidades financieras, erigiéndose como una verdadera manifestación de Responsabilidad Social Empresaria. he simplicity and ease with which loans are granted at present, contributes to overindebtedness of consumers, creating a pressing economic and social problems, as well as to medium term, the congestion of the courts. Compliance with this inform obligation will contribute to the prevention of overindebtedness of consumers and, although it is understood that the source of this obligation is legal, should grow their respect for the will itself of financial institutions, establishing itself as a manifestation Corporate Social Responsibility.
